Keeping evidence of workplace sexual harassment

If you experience sexual harassment in the workplace, it is important to keep any evidence you can. When you file a claim, be aware that the other party may simply deny your allegations. The evidence you have helps demonstrate what actually happened and prevents them from shifting blame onto you, even though you were the victim.

One step to take is simply writing everything down. Keeping a journal of events can be helpful. You can jot down comments that were made, jokes made at your expense, unwelcome sexual advances or any unwanted touching that occurred in the workplace. This way, when you move forward with your claim, you have a clear record outlining what happened and how you believe it violated your rights.

Digital evidence

In addition to your own notes, it is often a good idea to keep digital evidence. Examples include:

  • Text messages you received from the other party
  • Email messages
  • Pictures or videos
  • Voice recordings or voicemail records
  • Screenshots of social media posts or direct messages

Keep in mind that the other party may attempt to delete content, especially if the harassment occurred online. For example, if a coworker made inappropriate comments on your social media profile, take a screenshot of those comments, as they may try to remove them later. Once you have saved a record of what occurred, store those digital files in a secure location where they cannot be deleted without your consent.
